Terms of Use
These terms govern your access to and use of the Handspring pre-launch website at hsring.com, including the waitlist sign-up. By using the site, you agree to them. If you do not agree, please don't use the site.
1. The service
Right now, "the service" means a marketing website where you can learn about the upcoming Handspring smart ring and join a waitlist to receive launch information. No ring is being sold yet, and joining the waitlist is not a purchase, a deposit, or an order.
2. Eligibility
You must be at least 16 years old to use this site or join the waitlist. By submitting the form, you represent that you meet this requirement.
3. The waitlist
- Joining the waitlist is free and does not commit you to buy anything.
- We may use the waitlist to plan our launch, to send you product updates, and — when we open orders — to invite waitlist members first.
- Founding-member pricing, batch sizes, and availability are at our discretion and subject to change. We will be clear about the terms of any future offer when we make it.
- You can leave the waitlist at any time by emailing hi@hsring.com.
4. Accurate information
You agree to provide an email address that is yours and that you actively monitor, and not to use someone else's identity. We may remove waitlist entries that appear to be fraudulent, automated, or otherwise abusive.
5. Acceptable use
You agree not to:
- Use the site in any way that interferes with its operation or with other users.
- Attempt to gain unauthorized access to any part of the service.
- Submit content that is unlawful, infringing, hateful, harassing, or deceptive.
- Use automated tools to scrape, harvest, or otherwise collect information from the site without our written permission.
6. Intellectual property
The Handspring name, logo, copy, product photography, and design of this website are owned by us or our licensors. You may not copy, modify, distribute, or otherwise use them without prior written permission, except for ordinary personal viewing of the website.
7. Forward-looking statements
Anything we say about future product features, specifications, pricing, timelines, or availability is our current intent and may change as the product develops. We do not guarantee that any feature described on this site will be present in the shipping product.
8. Third-party links
The site may link to third-party websites or services. We are not responsible for the content, policies, or practices of those third parties. Your interactions with them are governed by their own terms.
9. Disclaimer of warranties
The site is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.
10. Limitation of liability
To the maximum extent permitted by law, Handspring will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the site. Our total liability for any claim relating to the site will not exceed one hundred US dollars (USD $100).
Nothing in these terms limits any liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold harmless Handspring and its team from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these terms or your misuse of the site.
12. Termination
We may suspend or end your access to the site, or remove your waitlist entry, at any time and for any reason — for example, if you breach these terms. You can stop using the site at any time.
13. Changes
We may update these terms as the product evolves. We'll post the updated terms here with a new "last updated" date. Continued use of the site after a change means you accept the updated terms.
14. Governing law
These terms are governed by and construed in accordance with applicable laws, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these terms will be resolved in the competent courts of our place of business, unless otherwise required by mandatory consumer-protection law in your country of residence.
